According to our previous announcement that Myanmar IPD announced that the Copyright Law came into effect on October 31, 2023. We are pleased to inform you that Copyrights and related rights applications can be filed in Myanmar from the Date of February 9, 2024 according to the Notification No. 4/2024 dated February 9, 2024 issued by Myanmar IP Department. Then IP Agency has issued Notification no.1/2024 dated February 13, 2024 in respect of Official fees for registration of Copyrights.
 
The applicants who want to file Copyrights and related rights application in Myanmar can inform us details of applicant and proposed Copyrights and related rights, so that we can prepare the required documents for your execution.
 
Please find the information of requirements, procedures, time frame and the official fee as follows:

Requirements:
-Any author or owner of copyright or owner of related rights may apply, with application form (CR-1) if he or she wishes to register literary or artistic work and with application form (CR-2) if he or she wishes to register related rights.
-The foreign works can be registered in Myanmar if the work is first published in other country and also published in Myanmar within thirty days from the first publication.
-Appointment of representative (CR-10) form must be executed and it needs to be notarized by the Notary Public.
 
Procedures:
 E-filing applications are to be filed via the stipulated account of authorized Representative into IP Department’s E-filing system.
 
Time frame:
This Copyrights registration system is just started in Myanmar therefore exact time frame could not be informed at this stage. We can expect that if it is smooth registration without involving office action, it may take in the range of at least 6 to 9 months from filing up to obtaining registration certificate.

[Remark] Protection of computer software and database in Myanmar
" Computer Software" and "database" may be registrable under Copyright law in Myanmar as the original creation of literary or artistic work.  The software/ database shall apply the same fee as other copyright works. Please find followings relevant articles of Copyright Law (2019) for your reference.
Section 13 (a) of Copyright Law(2019) prescribed as follows:
    13. The following literary or artistic works which are original intellectual  creations shall be protected:
        (a) books, pamphlets, poems, novels, articles, computer programmes and other writings;
 Section 15 (c) of Copyright Law (2019) prescribed as follows:
        15. The following derivative works shall be protected without prejudice to the copyright of the original literary or artistic works:
        (a) .................
        (b) ..................
        (c) compilations of data whether in machine readable or other form, provided that such collections must constitute intellectual creation by reason of the selection or arrangement of their content but contents of the collection shall not be concerned with the protection.
Thus, the “computer software” and  "database"  (in other word : a collection of independent works, data or other materials which are arranged in a systematic or methodical way and are individually accessible by electronic or other means) may be registrable under Copyright law in Myanmar as the original  literary  or artistic work.
